Petitioner challenged the constitutionality of a portion of a decree covering the financing of health services, which included a “professional” factor in determining the amount of funding for local governments. This provided more funding for doctors with higher skills, as opposed to merely the number of years spent as a public servant or the number of registered patients. Petitioner alleged that this was unconstitutional because it would discriminate against certain local governments.
The Court held that the provision was constitutional. The Court noted the constitutional right to health and that providing more funding for more skilled doctors incentivizes local governments to find the most skilled practitioners to serve the citizens, resulting in better medical care for the people. Those doctors, in general, tend to charge more, so this also helps cover those higher costs.

A szakmai szorzó, mint a társadalombiztosítási finanszírozás egyik eleme egyfelől a magasabb képesítéshez társuló összetettebb szolgáltatás magasabb költségeit téríti, másfelől lehetőséget biztosít a háziorvosi szolgálatok működtetőinek, hogy minél képzettebb szakembereket bízzanak meg lakosságuk egészségügyi alapellátásával. Ez az Alkotmány 70/D. §-át szolgáló intézkedés kellő súlyú alkotmányos indok a támogatás különbözősége mellett.” (p. 2)
“One of the tools of realizing the highest possible level of physical and mental health is the highest possible skill of the doctor providing health care services. The fee of doctors with higher skills and longer practice is also higher. This is covered by the higher social security support, which increases with the so-called professional factor for local governments employing doctors with higher skills. …
Professional factor, as one of the elements of financing social insurance on the one hand covers the higher costs of more complex services associated with higher skills. On the other hand, it provides an opportunity for those operating GP services to assign professionals with the highest possible skills to provide basic health services for their inhabitants. These [right to health] provisions constituting Article 70/D of the Constitution provide significant constitutional reason to allow differential support.” (p. 2)
