Petitioner brought an action against the Social Security Service of Costa Rica, asserting that the institution arbitrarily stopped providing patients with pharmaceuticals for the treatment of HIV/AIDS, in violation of petitioner’s constitutional right to health. The petitioner sought the recognition of an obligation on the part of the Social Security Service of Costa Rica to provide access to the medications.
The Court rejected the petitioner’s request for judicial protection. The Court noted that on the basis of scientific studies from the National Pharmacotherapy Department, the drug requested was not definitively proven to cure patients in any way. Moreover, the study cited emphasized that the drugs might impose unhealthy collateral effects on patients, and therefore the Court found the petitioner’s right to health had not been violated. Finally, the Court stated that ordering the Social Security Service of Costa Rica to provide the drugs requested under its current financial status would be extremely onerous. In this sense, the Court opined that HIV/AIDS patients are not the only sector of society with urgent medical needs.
CONSIDERANDO:
El amparo se dirige contra la negativa de la entidad demandada a adquirir la droga denominada AZT para atender a los enfermos de SIDA. Pero del informe que se ha rendido a la Sala y la documentación acompañada, se desprende que un dictamen técnico-científico, emanado del Departamento de Farmacoterapia de la accionada que atiende esos asuntos en la entidad demandada, es adverso a esa posibilidad. Por una parte, se afirma que los estudios y análisis de la droga en mención no son concluyentes y, a esta fecha, no se puede afirmar que cure, aparte de que se han detectado ciertos efectos secundarios que complican el cuadro general del enfermo. Por otro, puede agregarse un elemento financiero: el costo de adquisición de la droga implicaría un sacrificio muy grande para la medicina social, que no cuenta con un presupuesto propio para tal empresa. Pues si se tratara de adquirir para este tipo de enfermos, las medicinas o equipos necesarios para su actuación, ¿por qué no hacer lo propio con otros, que se encuentran en una situación de carácter delicado o terminal? La Sala considera que este aspecto no puede quedar inadvertido: hay determinadas enfermedades para las que aún no se cuenta con presupuestos que puedan hacerle frente y desde esa perspectiva el exigir a la Caja Costarricense de Segura Social que desatienda determinados programas para atender a quienes sufren de SIDA, por más que parezca duro, no es razonable, máxime si, como acepta esta Sala, el criterio científico que se presentó, indica que la AZT no se traduce en cura para el enfermo, si no una cierta _y deteriorada_ prolongación del término vital.
